Okay now lets start from the beginning with the fact that originally it was reversed with Snkplaymore suing Square Enix over the use of their character in one of enix manga High Score Girl. Now we have Square Enix suing Snkplaymore over the what they are being sued. It should be pointed that the manga uses characters from other famous game serious but they asked permission. Snkplaymore had tried to talk to Square Enix but they got nothing so they did try to leave the court out of this. At this moment Square Enix is now seeking a higher court to see that they are not violating Snkplaymore copyrights.
